Save Women’s Sports Act ruling appealed to U.S. Supreme Court
(The Center Square) – West Virginia filed its appeal with the U.S. Supreme Court, as promised, after a court struck down the state’s Save Women’s Sports Act.
West Virginia Attorney General Patrick Morrisey announced the filing on Tuesday afternoon, saying the law is necessary to prevent those who are male at birth from competing on girls’ sports teams in the state.
Morrisey was joined in the filing announcement by Lainey Armistead, West Virginia State University women’s soccer alumna.
“When biological males compete and win in a women’s event, female athletes lose their opportunity to shine,” Morrisey said. “This isn’t just about common sense, this isn’t fair on any level.”
The law was challenged in the case of a 13-year-old eighth-grade student identifying as a girl since the third grade and taking puberty blocking medication.
The 4th Circuit Court of Appeals recently struck down the law in a 2-1 ruling and then Morrisey vowed to appeal.
