Monument company must pay more than $200K in fines, restitution
(The Center Square) – A monument sales company has been ordered to pay nearly $79,000 in restitution and $125,000 in civil penalties for taking money and not delivering on promises in West Virginia.
Naylor Monument Sales and Naylor Monument Company of Clendenin are prevented from doing business in the state following the resolution of the lawsuit, brought by Attorney General Patrick Morrisey.
“This is a great win for the consumers victimized by this defendant,” Morrisey said. “Let this be a lesson to those intending to cheat consumers: you must follow the law if you want to do business in West Virginia and be honest about your work.”
Several consumers alerted the attorney general’s office that the company had taken payment but not delivered cemetery monuments and more complaints were submitted after the lawsuit was filed.
One consumer from Cross Lines placed an order in October 2021 for engraving the date of her mother’s death on a headstone and the company did not do the work, refund the money or respond to calls or text messages.
“Those who defraud consumers must be held accountable to the full extent of the law,” Morrisey said.
